# Terms of Service

## 1. Agreement to Terms

By accessing or using Coachie ("we," "our," or "us"), including our mobile application, web application, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Coachie. We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the updated Terms.

## 2. Description of Service

Coachie is a health and fitness tracking application that provides:

- **Health Tracking:** Meal logging, workout tracking, sleep monitoring, water intake, weight tracking, mood logging, supplement tracking, and menstrual cycle tracking

- **AI-Powered Features:** Personalized meal recommendations, photo-based food detection, AI coaching, chat assistance, and automated insights

- **Meal Planning:** Weekly meal blueprints, shopping lists, and recipe management

- **Social Features:** Friends, circles, forums, messaging, and recipe sharing

- **Progress Tracking:** Daily scores, habit tracking, and progress analytics

- **Subscription Services:** Free and Pro tier subscriptions with different feature access

## 3. Eligibility and Account Registration

### 3.1 Age Requirements

You must be at least **13 years of age** (or 16 in the European Economic Area) to use our Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

### 3.2 Account Creation

To use certain features of the Service, you must create an account by providing:

- Your name

- Email address

- Password

- Other information as requested

### 3.3 Account Security

You are responsible for:

- Maintaining the confidentiality of your account credentials

- All activities that occur under your account

- Notifying us immediately of any unauthorized use

- Ensuring your account information is accurate and up-to-date

### 3.4 Account Restrictions

You may not:

- Create multiple accounts to circumvent restrictions or limits

- Share your account credentials with others

- Use another person's account without permission

- Create an account if you are prohibited from receiving our services under applicable laws

## 4. Acceptable Use

### 4.1 Permitted Use

You may use the Service for lawful purposes in accordance with these Terms. You agree to:

- Provide accurate and truthful information

- Use the Service in compliance with all applicable laws and regulations

- Respect the rights of other users

- Maintain the security and integrity of the Service

### 4.2 Prohibited Activities

You agree NOT to:

- **Violate Laws:** Use the Service for any illegal purpose or in violation of any local, state, national, or international law

- **Impersonate:** Impersonate any person or entity or falsely state or misrepresent your affiliation

- **Spam:** Send unsolicited messages, spam, or chain letters

- **Interfere:** Interfere with or disrupt the Service, servers, or networks connected to the Service

- **Reverse Engineer:** Attempt to reverse engineer, decompile, or disassemble any part of the Service

- **Automated Access:** Use bots, scrapers, or other automated means to access the Service without permission

- **Data Mining:** Extract or collect data from the Service for commercial purposes without authorization

- **Malicious Code:** Introduce viruses, malware, or other harmful code

- **Circumvent Security:** Attempt to bypass security measures or access restricted areas

- **False Information:** Provide false, misleading, or inaccurate information

- **Violate Rights:** Infringe upon intellectual property rights, privacy rights, or other rights of others

### 4.3 Content Standards

When posting content (forum posts, messages, comments, etc.), you agree not to post content that:

- Is illegal, harmful, or violates any laws

- Is defamatory, libelous, or slanderous

- Is obscene, pornographic, or sexually explicit

- Promotes violence, hate speech, or discrimination

- Contains personal information of others without consent

- Is spam, advertising, or promotional material (unless authorized)

- Violates intellectual property rights

- Contains false or misleading information

- Is otherwise objectionable in our sole discretion

## 5. User Content

### 5.1 Your Content

You retain ownership of content you create, upload, or post through the Service ("User Content"), including:

- Health logs and data

- Recipes and meal plans

- Forum posts and comments

- Messages and conversations

- Photos and images

### 5.2 License to Coachie

By submitting User Content, you grant Coachie a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to:

- Use, reproduce, modify, adapt, publish, translate, and distribute your User Content

- Display and perform your User Content in connection with the Service

- Use your User Content for service improvement, analytics, and research (in anonymized, aggregated form)

This license allows us to operate, improve, and provide the Service. You can revoke this license by deleting your User Content or account.

### 5.3 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

- You own or have the right to submit the User Content

- Your User Content does not violate any third-party rights

- Your User Content complies with these Terms and applicable laws

### 5.4 Content Removal

We reserve the right to:

- Remove, edit, or refuse to post any User Content

- Remove User Content that violates these Terms or is otherwise objectionable

- Terminate accounts of users who repeatedly violate these Terms

## 6. Intellectual Property

### 6.1 Service Ownership

The Service, including its design, features, functionality, and content (excluding User Content), is owned by Coachie and protected by copyright, trademark, and other intellectual property laws.

### 6.2 Our Rights

You acknowledge that:

- The Service contains proprietary and confidential information

- You will not copy, modify, or create derivative works of the Service

- You will not remove any copyright, trademark, or other proprietary notices

- Coachie trademarks, logos, and service marks are our property

### 6.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

- Access and use the Service for personal, non-commercial purposes

- Download and use the mobile application on your personal devices

This license does not permit:

- Commercial use of the Service

- Resale or redistribution of the Service

- Use of our trademarks or branding without permission

## 7. Subscriptions and Payments

### 7.1 Subscription Tiers

Coachie offers:

- **Free Tier:** Basic features with limited access

- **Pro Tier:** Full access to all features, including AI-powered features, unlimited meal plans, and advanced tracking

### 7.2 Subscription Terms

- Subscriptions are billed on a recurring basis (monthly or annually)

- Subscription fees are charged in advance

- Prices are subject to change with notice

- Subscription automatically renews unless cancelled

### 7.3 Payment

- You agree to pay all fees associated with your subscription

- Payments are processed through Google Play (Android) or Apple App Store (iOS)

- You are responsible for any taxes applicable to your subscription

- Refunds are subject to the policies of Google Play or Apple App Store

### 7.4 Cancellation

- You may cancel your subscription at any time through your device's app store settings

- Cancellation takes effect at the end of your current billing period

- You will continue to have access to Pro features until the end of your billing period

- No refunds for partial billing periods

### 7.5 Price Changes

- We may change subscription prices with 30 days' notice

- Price changes will not affect your current billing period

- Continued use after a price increase constitutes acceptance

## 8. Health and Medical Disclaimer

### 8.1 Not Medical Advice

**IMPORTANT:** The Service provides health and fitness information for informational purposes only. The Service is NOT:

- A substitute for professional medical advice, diagnosis, or treatment

- Intended to diagnose, treat, cure, or prevent any disease

- A replacement for consultation with qualified health professionals

### 8.2 Consult Healthcare Providers

You should:

- Consult with qualified healthcare providers before starting any diet or exercise program

- Seek medical attention for any health concerns

- Not rely on the Service for medical decisions

- Inform your healthcare providers about your use of the Service

### 8.3 No Medical Relationship

Use of the Service does not create a doctor-patient, therapist-patient, or other professional relationship between you and Coachie.

### 8.4 Emergency Situations

The Service is not for medical emergencies. In case of a medical emergency, call your local emergency services immediately.

## 9. AI-Generated Content

### 9.1 AI Features

The Service uses artificial intelligence (OpenAI, Google Gemini) to provide:

- Meal recommendations

- Food identification from photos

- Personalized coaching and insights

- Chat assistance

### 9.2 AI Limitations

You acknowledge that:

- AI-generated content may contain errors or inaccuracies

- AI recommendations are suggestions, not medical advice

- You should verify AI-generated information independently

- We are not responsible for decisions made based on AI-generated content

### 9.3 AI Content Accuracy

While we strive for accuracy, we do not guarantee:

- The accuracy, completeness, or reliability of AI-generated content

- That AI recommendations will achieve desired results

- That AI content is free from errors

## 10. Third-Party Services and Links

### 10.1 Third-Party Integrations

The Service may integrate with third-party services, including:

- Google Fit

- Health Connect

- Google Play Services

- Apple App Store

### 10.2 Third-Party Terms

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for third-party services.

### 10.3 External Links

The Service may contain links to external websites. We are not responsible for:

- The content of external websites

- The privacy practices of external websites

- Any damages resulting from use of external websites

## 11. Disclaimers and Limitations of Liability

### 11.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- WARRANTIES OF MERCHANTABILITY

- FITNESS FOR A PARTICULAR PURPOSE

- NON-INFRINGEMENT

- ACCURACY, RELIABILITY, OR COMPLETENESS

### 11.2 No Guarantees

We do not guarantee that:

- The Service will be uninterrupted, secure, or error-free

- Defects will be corrected

- The Service is free from viruses or harmful components

- Results will be achieved from using the Service

### 11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COACHIE SHALL NOT BE LIABLE FOR:

- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

- LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES

- DAMAGES RESULTING FROM USE OR INABILITY TO USE THE SERVICE

- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS OR ALTERATION OF YOUR DATA

### 11.4 Maximum Liability

Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

### 11.5 Exceptions

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

## 12. Indemnification

You agree to indemnify, defend, and hold harmless Coachie, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

- Your use of the Service

- Your violation of these Terms

- Your violation of any rights of another

- Your User Content

## 13. Termination

### 13.1 Termination by You

You may terminate your account at any time by:

- Using the "Delete Account" feature in Settings

- Contacting us at support@playspace.games

### 13.2 Termination by Us

We may suspend or terminate your account if:

- You violate these Terms

- You engage in fraudulent, illegal, or harmful activity

- You fail to pay subscription fees (if applicable)

- We discontinue the Service

- For any other reason in our sole discretion

### 13.3 Effect of Termination

Upon termination:

- Your right to use the Service immediately ceases

- Your account and data may be deleted (subject to our Privacy Policy)

- You remain liable for all amounts due

- Provisions that by their nature should survive will survive

## 14. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our Privacy Policy.

## 15. Dispute Resolution

### 15.1 Informal Resolution

Before filing a claim, you agree to contact us at support@playspace.games to attempt to resolve the dispute informally.

### 15.2 Binding Arbitration (U.S. Users)

For users in the United States:

- Any disputes will be resolved through binding arbitration

- Arbitration will be conducted under the rules of the American Arbitration Association

- You waive your right to a jury trial and to participate in class actions

- Arbitration will take place in Florida

### 15.3 Exceptions

The following disputes are not subject to arbitration:

- Disputes related to intellectual property

- Disputes seeking injunctive relief

- Small claims court disputes

### 15.4 Class Action Waiver

You agree not to participate in class actions or consolidated proceedings against Coachie.

## 16. Governing Law

These Terms are governed by the laws of Florida, without regard to conflict of law principles.

For users in the European Economic Area, these Terms are governed by the laws of Florida, and you may have additional rights under local consumer protection laws.

## 17. Changes to Terms

### 17.1 Updates

We may modify these Terms at any time. Material changes will be notified through:

- In-app notification

- Email (if you have provided one)

- Updated "Last Updated" date

### 17.2 Acceptance

Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.

## 18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

## 19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Coachie regarding the Service and supersede all prior agreements.

## 20. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

## 21. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

## 22. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet failures.

- We are not responsible for health decisions made based on your data

- Health data is processed in accordance with our Privacy Policy

### 24.3 AI Features

- AI-generated content is provided for informational purposes

- You should verify AI recommendations independently

- We are not responsible for outcomes based on AI suggestions

## 25. Acknowledgment

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT:

- You have read and understood these Terms

- You agree to be bound by these Terms

- You are at least 13 years old (or 16 in the EEA)

- You will comply with all applicable laws and regulations
